These Terms of Service ("Terms") govern your use of MarketScout (the "Service"), operated by Thomas Frechette, a sole proprietor doing business in Cincinnati, Ohio ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms.
MarketScout helps makers and small-business vendors search for craft fairs, markets, and festivals, and track events they're interested in applying to. The Service is provided "as is" and is under active development; features, limits, and pricing may change.
You must provide a valid email address to create an account and are responsible for keeping your login credentials secure. You must be at least 18 years old to use the Service.
Event listings are gathered using automated web search and may be incomplete, outdated, or inaccurate. MarketScout is a discovery tool, not a source of truth — always verify application deadlines, fees, and requirements directly with the event organizer before applying or paying anything.
MarketScout offers a free tier and a paid subscription tier. Paid subscriptions are billed monthly in advance and renew automatically until canceled. Billing is processed by Paddle.com Market Limited, acting as Merchant of Record — your payment relationship for billing purposes is with Paddle, not directly with us. You agree not to: use the Service for any unlawful purpose; attempt to circumvent search or account limits through automation or multiple accounts; scrape, resell, or redistribute the Service's data at scale; or interfere with the Service's normal operation.
The Service's software, design, and branding are owned by us. Event data is aggregated from public sources and provided for your personal/business use, not for resale.
The Service is provided without warranties of any kind, express or implied, including fitness for a particular purpose or that results will be accurate, complete, or uninterrupted.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including missed application deadlines, lost fees, or decisions made based on Service data. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose.
You may stop using the Service and cancel your subscription at any time from Settings. We may suspend or terminate accounts that violate these Terms.
We may update these Terms as the Service evolves. Continued use after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law principles.
